March 1, 2025Leopolis.news journalists have uncovered a scheme of misappropriation of municipal property in Lviv that is very similar to the scandalous “Scam of the Century.” Among its defendants are the “responsible persons” of the municipal property department of the Economic Policy Department of the Lviv City Council, the same department that was headed for 10 years by Inna Svystun, who is widely regarded as the scandalous godmother of Andriy Sadovyi. It is likely that these are deals that were a kind of “rehearsal” for the large-scale “Scam of the Century” that resulted in the loss of more than 40 real estate properties in the city between April and November 2016.
How a leased property can easily disappear in the city of Lviv
In our case, we are talking about a building at 50 Akademika S. Yefremova St., Lviv, which has belonged to the city’s territorial community since 1987. It is known that it was a one-story facility consisting of three premises with a total area of 59.8 square meters.
It is also known that on December 24, 2014, the Department of Communal Property of the Lviv City Council, represented by the Head of the Department Inna Svystun, and Lvivsky Likhtar, represented by the Director Andriy Struk, entered into a lease agreement No. F-9322-14 for real estate, according to which the premises at 50 Yefremova Street (with a book value of UAH 143.1 thousand) were leased to the utility company for official purposes. The term of the lease agreement was set until 23.12.2017, the rent amount was UAH 1 (one) per year.
The territorial community of Lviv, represented by the Lviv City Council, as the owner of the municipal property, has never given its consent to the alienation of the said real estate, and the City Council did not adopt such a decision on alienation.
Upon expiration of the lease agreement (in accordance with its terms, given that the agreement was not early terminated or terminated), the parties had to start transferring the object to the lessor, i.e. the municipal property department.
However, this did not happen. And, as it turned out later, it could not have happened. Because the leased property (a one-story building at 50 Yevremova Street) had already disappeared by that time.
The fact that this object “is actually absent, instead of it, a three-story building was found, which is owned by an individual, will become known thanks to an audit by the Western Office of the State Audit Service. It is an audit of certain issues of financial and economic activities of the communal property department of the Department of Economic Development of the Lviv City Council for the period from 01.06.2014 to 30.11.2017 (its results are reflected in the act of 23.03.2018).
According to these results, no inspection reports of the said non-residential premises for 2015-2017 on compliance with the terms of the lease agreement of 24.12.2014 No. F-9322-14 were presented during the audit. In other words, we are talking, in particular, about ironclad evidence of official negligence of officials of the communal property department.
However, for some reason, law enforcement agencies will respond to this only ten months later. The relevant criminal proceedings, in which the pre-trial investigation will be initiated by the Investigation Department of the Main Department of the National Police in Lviv Oblast, will be registered on January 25, 2019. This is case No. 42019140000000024 under Part 2 of Article 367, Part H of Article 190 of the Criminal Code of Ukraine: on the fact of improper exercise of the landlord’s control powers by the responsible persons of the Communal Property Department of the Lviv City Council, as well as illegal actions of the responsible persons of Lvivsky Likhtar regarding the use of the leased object in accordance with its intended purpose and in accordance with the terms of the contract, as a result of which non-residential premises at 50 Akademika S. Yefremova Street, Lviv, were illegally withdrawn from communal ownership. In addition, the said criminal proceedings were initiated on the fact of fraudulent acquisition of the said premises.
What became known during the investigation
The investigation, as evidenced by the rulings of the district courts of Lviv (relating to the criminal proceedings), established, in particular, the following facts.
On April 10, 2025, the non-residential premises with an area of 59.8 square meters at 50 Yefremova Street, which was leased (on the balance sheet) by Lvivskyi Lichtar (for storing the working equipment of the company’s employees), were sold by the Private Enterprise “Scale” to an individual (as it turned out, this person was Oleh Partyka). This happened on the basis of a sale and purchase agreement dated 10.04.2015.
In its turn, the premises became the property of PE “Masscale” on the basis of a fictitious sale and purchase agreement dated 10.03.2000 (the agreement was concluded with a LLC, but the author of these lines was unable to establish its name), an act of acceptance and transfer of the premises dated 10.03.2000 and a registration certificate of series KMM No. 003313 issued on 14.03.2000. Lviv Regional State Bureau of Technical Inventory and Expert Evaluation.
Subsequently, Mr. Partyka appealed to the Lviv City Council. O.R. Partyka applied to the Lviv City Council for “approval of urban planning conditions and restrictions on the development of a land plot for the reconstruction of non-residential premises at 50-A Akademika S. Yefremova Street with the expansion by means of a superstructure for a residential building”. The appeal was registered with the Lviv City Council on 21.12.2016.
As for the other address, which appears in it, the investigation found that the conclusion on the technical feasibility of separating the specified non-residential premises into a separate room as a whole and assigning an address: Lviv, 50-A Akademika S. Yefremova St. was issued by the OKP LOR “BTI and EO”. In particular, on the basis of the letter of Lvivskyi Likhtar Municipal Company (the balance holder and tenant of the said non-residential premises of communal property) dated 22.01.2016 No. 9, which states that the utility company does not object to the assignment of a separate number to the said premises, which is privately owned by an individual.
The decision of Lviv City Council No. 233, signed by Lviv Mayor A. Sadovyi (based on the results of consideration of the appeal of citizen O. Partyka), was dated March 27, 2017. That is, there were still 9 months left before the expiration of the lease agreement for the premises at 50 Yefremova Street, which (according to the agreement) belonged to the territorial community of Lviv, when the mayor signed a resolution that allowed the reconstruction and extension of the same premises with a total area of 59.8 square meters (but with an “updated” address) to its new owner. And no one noticed anything “strange”.
As a result, gr. Partyka O.R. built (built on) a three-storey residential building with a total area of 173.2 sq.m. at the address: Lviv, 50a Yefremova Street, which was registered on 20.11.2019 by the state registrar of Zhyriv village council of Pustomyty district Pavlo Tuzyak.
On the investigation without results and Sadovyi’s “survivability”
According to open sources, the police investigative authorities have been investigating the criminal case of the “disappearance” of the leased object due to official negligence, including the “responsible persons” of the municipal property department, for more than five years. However, without results.
This case remained factual, and no suspects were brought forward. The only “shift” was that the criminal proceedings were transferred from the Investigation Department of the Main Department of the National Police in Lviv Oblast to the Police Department No. 1 of the Lviv District Police Department No. 2 of the Main Department of the National Police in Lviv Oblast for pre-trial investigation. This happened on the basis of a decision of the prosecutor of the Frankivsk District Prosecutor’s Office of Lviv dated 10/17/2023 (as stated in the court decision of 08/03/2024), according to which the territory of the Zaliznychnyi district of Lviv was determined as the place of investigation. Lviv. As a rule, such actions are taken when the case is going to be “buried” forever (i.e. closed).
Although its effective and efficient investigation could obviously lead law enforcement officers to a whole scheme of theft of municipal property in Lviv. Given, in particular, that the aforementioned PE “Scale” (according to YouControl, its owner and director is Dmytro Mykolayovych Malorodenko) also appears in criminal proceedings №72024142400000008 of 29.05.2024 under Part 1 of the Criminal Code of Ukraine. 1 Art. 205-1 of the Criminal Code of Ukraine (it concerns forgery of documents submitted for state registration of a legal entity). The case is being investigated by the Bureau of Economic Security.
It is also known from open sources that Dmytro Malorodenko is the director and owner of Lviv Carpenter PE, which was involved incriminal proceedings No. 42015140030000077 dated December 07, 2015 under Part 1 of Article 190, Part 4 of Article 358 of the Criminal Code of Ukraine, which was initiated on the fact of committing fraudulent acts and using knowingly forged documents. In particular, the case concerns an attempt by Lviv Carpenter PE to illegally seize a 200.4 sq.m. warehouse building at 115a Zelena St., Lviv, owned by the territorial community of Lviv (using a scheme similar to the one used to illegally appropriate the premises at 50 Yefremova St., Lviv).
The pre-trial investigation in this case was carried out by the Investigation Department of the Lychakivskyi District Police Department in Lviv Oblast. However, there is no information about its results.
Isn’t this, by the way, one of the reasons for Andriy Sadovyi’s “survivability” as mayor of Lviv? Is this referring to the very interesting fact that criminal cases on the facts of embezzlement, carve-up of municipal property, offenses, and abuses by his subordinates (which were initiated by Lviv law enforcement officers in “batches” during his mayoralty), for some reason, almost always ended in failure?
