
High Anti-Corruption Court Orders NABU to Open Case on Mayor Sadovyi’s Abuse

August 16, 2024In 2021, the executive committee of the Lviv City Council, headed by the mayor Andriy Sadovyi, made an illegal and unjustified decision to raise public transportation prices in the city from 2024 to 25 hryvnias per ticket. This was reported by lawyer and activist Andriy Petryshyn on his Facebook page. On December 08, 2023, by Decision No. 1373 “On Amendments to the Decision of the Executive Committee of 31.12.2021 No. 1203”, the Executive Committee confirmed its decision of 31.12.2021 No. 1203 “On Setting Tariffs for Passenger Transportation Services by Electric and Automobile Passenger Transport on Public Routes in the Lviv City Territorial Community”. As part of the socially useful information project “Lviv Audit” analyzed these decisions and found a whole bunch of offenses on the part of the executive committee and the mayor himself, Andriy Sadovyi. Andriy Petryshyn filed a lawsuit with the Lviv District Administrative Court to cancel the illegal decision of the executive committee and the mayor to raise public transportation prices for residents of the united territorial community. The court proceedings are open, the trial is underway, and the perpetrators will not escape punishment. As Petryshyn has already noted, his team has uncovered many violations, and this is one of them: “According to the provisions of the Regulations of the Executive Committee of the Lviv City Council, approved by the Decision of the Lviv City Council No. 337 of 29.04.2021, the minutes of the executive committee meeting, which is a basic document, are signed by the mayor of the city, and in case of his absence from the executive committee meeting, his first deputy signs them. Instead of the absent mayor, the first deputy presides over the executive committee. Andriy Sadovyi was absent from the executive committee meeting of December 08, 2023, which discussed the increase in transportation prices, as evidenced by the documents we received. Therefore, according to the provisions of the Regulations, the executive committee was chaired and chaired by his first deputy, Moskalenko, who, again, was supposed to sign the minutes of the executive committee meeting. However, the document was signed by Andriy Sadovyi, who was absent from the executive committee meeting that day, and this is a sign of criminal offenses. Taken together, they are defined in Articles 358, 364, 366 of the Criminal Code of Ukraine.
What made Andriy Sadovyi take a risk and commit a crime. The answer is obvious – money!
According to insiders, Petryshyn and his team are involved in the transportation business with huge amounts of unaccounted-for cash, the so-called shadow cash desk. The lion’s share of transportation is carried out by Lviv Municipal Motor Carrier No. 1. Which is completely subordinate to Sadovyi. Criminal proceedings were opened against ATP No. 1 and its director, but instead of ordering official investigations, the mayor of Sadovyi constantly defended the director and called him an effective manager. It is more than clear why! Let’s ask ourselves why Andriy Moskalenko did not sign the minutes of the executive committee meeting of December 08, 2023, No. 102? Again, according to Petryshyn’s team, Moskalenko, realizing that the executive committee’s decision to raise transportation prices was completely unjustified and smacked of criminal activity, did not dare to sign. And then Sadovyi, committing a criminal violation, himself certified this document. Petryshyn intends to summon Moskalenko’s first deputy and the mayor of the city, Andriy Sadovyi, to the court hearing to explain to the court and the Lviv community what was the reason for Moskalenko not to sign the minutes of the executive committee meeting. And what prompted Andriy Sadovyi to sign the document and commit the crime. To ensure that the perpetrators are punished, spread the word, comment, and we will continue to work. Below are the documents received as part of the case: 1. “Minutes No. 102 of the meeting of the executive committee of the Lviv City Council (the meeting was held in room 230)” contains the signature of the Lviv mayor, Andriy Sadovyi. Although as stated in the narrative part of the Protocol, A. Sadovyi was absent from the meeting on December 08, 2023.  
  2. Regulations of the Executive Committee of the Lviv City Council, approved by the Decision of the Lviv City Council No. 337 dated 04/29/2021, which establishes the following: 5.2. In the absence of the Lviv city mayor, the meeting of the executive committee of the Lviv city council is chaired by the first deputy mayor – deputy mayor for economic development. 6.4. The minutes of the meeting of the executive committee of Lviv city council shall include: 6.4.7. Signatures of the chairman of the meeting and the manager of the executive committee.
 2. Regulations of the Executive Committee of the Lviv City Council, approved by the Decision of the Lviv City Council No. 337 dated 04/29/2021, which establishes the following: 5.2. In the absence of the Lviv city mayor, the meeting of the executive committee of the Lviv city council is chaired by the first deputy mayor – deputy mayor for economic development. 6.4. The minutes of the meeting of the executive committee of Lviv city council shall include: 6.4.7. Signatures of the chairman of the meeting and the manager of the executive committee. 
 According to the received copy of the Minutes No. 102, which is in the case file (case file No. 30,31), the meeting of the executive committee on that day was chaired by the deputy mayor of the city – A. Moskalenko. Therefore, it is clearly seen that this Protocol No. 102 was not signed by the absent mayor Andriy Sadovyi, but by his first deputy Andriy Moskalenko, who presided over the meeting, as provided for by the Rules of Procedure. Therefore, signing of the minutes of the meeting from which the contested Decision was formed by an unauthorized person and use of such a document entails criminal liability.
